You can apply for bail if you have been detained by the UK Border Agency in a removal Centre for 7 days or more.
An application for bail is considered by the First Tier Tribunal where an independent judge will make a decision on whether detention should be maintained. We can represent detainees at a hearing for bail.
If bail is refused, the detainee has the right to apply for bail again after 28 days unless their circumstances have changed, in which case they can apply sooner.
For a bail application, sureties are often required. A surety is someone who promises to pay the government a bond if do not adhere to any bail conditions i.e. regular reporting. A financial bond is usually required and there is no set amount. A friend or relative can act as a surety if even they are not British.
